Rite Aid is potentially preparing to file for bankruptcy in the coming weeks due to a substantial number of federal and state lawsuits related to its alleged involvement in the opioid crisis. The chapter 11 filing would address the company's debt of over $3.3 billion and the pending legal claims that accuse it of oversupplying prescription painkillers. Rite Aid has not reached a settlement with the various plaintiffs, including federal and state governments, regarding the opioid liabilities. Rite Aid forecasts a loss of $700M in fiscal year 2024 and as a result, shuttered close to ~200 sites over the past two years. Per various sources - they're slated to close hundreds more moving forward. As a landlord, if your portfolio is exposed heavily to Rite Aid credit - this is something that should be on your radar. An IL jury returns a verdict finding the plaintiff 80% at fault *and* awards damages.The trial judge informs the jury that 80% fault means no award for the plaintiff.The jury gets a "do over" and returns another verdict finding the plaintiff 0% at fault and awards the same net damages.Appellate court: a jury cannot deliberate twice.A few observations:Verdict forms are confusing to non-lawyers.The jury missed an express warning in the instructions that a finding over 50% against the plaintiff would bar recovery.Both times the jury awarded the plaintiff less than her medical expenses.No one knows what a jury is going to do.*Hassard v.
